The Current Fluoridation Law
Under current Massachusetts law (GL Chap.111, section 8C), fluoridation is ordered by a local Board of Health. Such an order is followed by a period of 90 days, during which, opponents can gather the signatures of 10% of the community's voters. If enough signatures are gathered, a binding public vote on the issue in a local election is required.
While the current law doesn't address whether or not Boards of Health can end fluoridation, the Massachusetts Association of Health Boards' "Guidebook for Massachusetts Boards of Health" clearly states that Boards of Health do have the authority to do so.
